1. Introduction
These Terms of Use govern access to and use of the TableGreet customer application, TableGreet driver application and associated ordering, payment, delivery, QR-menu and mobile services.
These Terms form a legally binding agreement between the user and TableGreet Inc., trading as “TableGreet,” with a registered address at 548 Market St, San Francisco, CA 94104, USA & Rabat, Morocco.
In these Terms:
- “TableGreet,” “we,” “us” or “our” means TableGreet Inc.
- “App” means the TableGreet customer application, TableGreet driver application and related mobile functionality.
- “Customer” means an individual using the App to browse, order, pay, collect, dine or receive delivery.
- “Driver” means an individual using the Driver App to accept or complete delivery services.
- “Venue” or “Merchant” means a restaurant, café, hotel, food business or participating merchant.
- “Order” means an order for food, drinks or other products submitted through the App.
- “Services” means the App and related TableGreet services.
By creating an account, placing an Order, accepting a delivery opportunity, clicking an acceptance button or otherwise using the Services, you agree to these Terms.
Do not use the Services if you do not agree.
2. Eligibility
2.1 Customers
Customer accounts are not available to children under 13.
Customers between 13 and the legal age of majority may use the App only:
- With permission and supervision from a parent or legal guardian;
- Where permitted by local law;
- Without purchasing age-restricted products;
- Using a payment method they are authorized to use.
A parent or guardian permitting a minor to use the App is responsible for the minor’s use to the extent permitted by law.
2.2 Drivers
Drivers must:
- Be at least 18 years old;
- Meet any higher age requirement under local law;
- Have legal capacity to enter into a contract;
- Have the legal right to work or provide delivery services;
- Hold all required licenses, registrations and insurance;
- Use a legally permitted and roadworthy vehicle;
- Meet TableGreet’s onboarding and verification requirements.
2.3 Authority
If you use the App for an organization, you confirm that you have authority to bind that organization to these Terms.
3. Account registration
Some features may be available without an account. Ordering, payments, rewards, saved history and Driver functionality may require registration.
You agree to:
- Provide accurate and current information;
- Keep your information updated;
- Maintain the confidentiality of login credentials;
- Protect verification codes;
- Use only your own account;
- Notify us promptly of unauthorized access;
- Accept responsibility for activity performed through your account unless caused by TableGreet’s failure to use reasonable security.
You must not:
- Create an account using another person’s identity;
- Transfer or sell an account;
- Maintain multiple accounts to abuse promotions;
- Permit unauthorized persons to use a Driver account;
- Circumvent verification, suspension or eligibility requirements.
We may request identity verification before permitting certain activities.
4. TableGreet’s role
TableGreet provides technology that may enable Customers to:
- Discover Venues;
- View menus;
- Scan QR codes;
- Submit dine-in requests;
- Place pickup or delivery Orders;
- Make payments;
- Communicate with Venues or Drivers;
- Receive rewards;
- Track Orders.
Unless checkout expressly identifies TableGreet or an affiliate as the seller, the relevant Venue is the seller of the products in an Order.
The Venue is generally responsible for:
- Menu content;
- Prices;
- Ingredients;
- Allergen declarations;
- Product availability;
- Food preparation;
- Food quality;
- Product descriptions;
- Required licenses;
- Taxes applicable to its sale;
- Order acceptance;
- Venue-controlled refunds;
- Compliance with food, health and consumer laws.
TableGreet remains responsible for its own obligations as a technology and service provider.
Nothing in these Terms removes legal rights that cannot lawfully be excluded.
5. Venue information and menu content
Venues provide or approve the menu information shown through the App.
Menu information may include:
- Product names;
- Photographs;
- Prices;
- Ingredients;
- Dietary labels;
- Allergen information;
- Availability;
- Preparation estimates;
- Promotional offers.
Venues must attempt to keep this information accurate, but availability, recipes and prices may change.
If there is a material discrepancy before an Order is accepted, the Customer may be asked to approve the change or cancel the affected item.
TableGreet does not independently inspect or verify every Venue, ingredient, dietary claim, image or menu statement.
6. Allergies and dietary requirements
Allergen and dietary information is normally supplied by the Venue.
Customers with allergies, intolerances, medical dietary restrictions or religious dietary requirements should contact the Venue directly before ordering.
Labels such as “allergen-free,” “vegetarian,” “vegan,” “halal,” “gluten-free” or similar descriptions do not guarantee:
- Complete absence of an ingredient;
- Absence of cross-contact or cross-contamination;
- Compliance with personal, medical or religious standards.
TableGreet is not a medical service and does not provide medical advice.
In an emergency, contact the appropriate local emergency service.
7. Placing an Order
The App allows Customers to submit an Order request to a Venue.
Before submitting an Order, the Customer must review:
- Venue;
- Items;
- Quantities;
- Modifiers;
- Delivery or pickup address;
- Table identifier;
- Timing;
- Price;
- Fees;
- Taxes;
- Tip;
- Payment method.
An Order is not necessarily accepted when it is submitted.
A binding sales contract generally forms when:
- The Venue accepts the Order; or
- The App displays another clear confirmation that acceptance has occurred.
The exact point of acceptance may vary by jurisdiction and Order type.
We may provide an electronic receipt or confirmation.
8. Order rejection and modification
A Venue or TableGreet may reject, modify or cancel an Order when reasonably necessary because of:
- Item unavailability;
- Venue closure;
- Pricing error;
- Technical error;
- Payment failure;
- Delivery unavailability;
- Safety concerns;
- Suspected fraud;
- Invalid address;
- Legal restrictions;
- Inability to fulfil special instructions.
Where practical, the Customer will be informed and offered:
- A replacement;
- A price adjustment;
- Partial cancellation;
- Full cancellation;
- Refund where payment has already been captured.
9. Prices, taxes and fees
Prices are displayed in the currency shown at checkout.
The total may include:
- Item prices;
- Taxes;
- Delivery fees;
- Service fees;
- Small-order fees;
- Packaging charges;
- Regulatory charges;
- Tips;
- Other clearly disclosed charges.
Fees may vary based on:
- Location;
- Distance;
- demand;
- Order size;
- Venue;
- Delivery method;
- Time;
- Promotions.
The final price will be displayed before the Customer confirms the Order, except where a change is permitted by law and clearly communicated.
If a clear pricing error occurs, the Order may be cancelled and any collected payment refunded.
10. Payments
Payments may be processed by one or more third-party payment providers.
By submitting payment information, the Customer confirms that:
- The payment method is valid;
- The Customer is authorized to use it;
- The information provided is accurate;
- Sufficient funds or credit are available.
The Customer authorizes the relevant payment provider and participating parties to:
- Authorize payment;
- Capture payment;
- Process adjustments;
- Issue refunds;
- Handle chargebacks;
- Verify the payment method;
- Perform fraud screening.
TableGreet may use tokenized payment credentials but does not intend to store complete card numbers or card security codes on its own systems.
The Customer may be subject to separate terms imposed by:
- Card issuers;
- Banks;
- Digital-wallet providers;
- Payment processors;
- Currency-conversion providers.
11. Payment authorization and capture
A temporary authorization may appear before an Order is accepted or completed.
Payment may be captured:
- When the Order is accepted;
- When preparation begins;
- When the Order is collected;
- When delivery is completed;
- At another time shown during checkout.
The final amount may change where the Customer approves substitutions, additions, tips or other permitted adjustments.
12. Tips
Customers may have the option to provide a tip to a Driver, Venue employee or other service provider.
The App will identify the intended recipient where practical.
Unless otherwise disclosed:
- Tips are voluntary;
- Tips are not required to receive ordinary service;
- TableGreet will not intentionally retain a portion of a tip designated for a Driver;
- Payment-processing deductions will be handled as disclosed or required by law;
- Tip adjustments may be limited after payment.
13. Cancellations
Cancellation rights depend on:
- Whether the Venue accepted the Order;
- Whether preparation started;
- Whether a Driver was assigned;
- Whether delivery began;
- Local consumer law;
- The specific Venue’s disclosed cancellation rules.
A Customer may be charged part or all of the Order when cancellation occurs after preparation or delivery work has begun, where legally permitted.
No cancellation fee will apply where cancellation results solely from a failure by the Venue, Driver or TableGreet to provide the agreed service.
14. Refunds and complaints
Customers should report:
- Missing items;
- Incorrect items;
- Damaged products;
- Quality concerns;
- Delivery problems;
- Unauthorized charges;
- Duplicate charges;
through the App or support@tablegreet.com within 14 days.
Refund decisions may consider:
- Order records;
- Photographs;
- Delivery confirmation;
- Venue information;
- Driver information;
- Previous refund activity;
- Applicable law.
Refunds may be issued by:
- The Venue;
- TableGreet acting for the Venue;
- The payment provider;
- Another party identified during checkout.
Approved refunds are normally returned to the original payment method. Processing times depend on the relevant financial institution.
These Terms do not limit mandatory refund, withdrawal or consumer-protection rights.
15. Dine-in features
Where supported, Customers may use the App to:
- Identify a table;
- View a live menu;
- Place an Order;
- Request a waiter;
- Request the bill;
- Pay at the table;
- Split payment;
- Access a receipt.
Customers must confirm that the displayed Venue and table are correct.
Dine-in requests do not guarantee immediate service. Venue staff remain responsible for managing the physical dining experience.
16. Pickup Orders
Customers must:
- Arrive at the displayed pickup location;
- Collect the Order within a reasonable period;
- Follow Venue instructions;
- Provide required confirmation;
- Verify the Order before leaving where reasonably possible.
If a Customer fails to collect an Order after preparation, the Customer may remain responsible for the charge where permitted by law.
17. Delivery Orders
Customers must provide:
- A complete and accurate address;
- Safe and lawful delivery instructions;
- A reachable telephone or in-app contact method;
- Access details where necessary;
- Any information reasonably needed to locate the delivery point.
Delivery times are estimates unless expressly guaranteed.
Weather, traffic, Venue delays, demand, road conditions, safety incidents and other circumstances may affect delivery time.
The Customer must not require a Driver to:
- Enter an unsafe location;
- Trespass;
- Break traffic laws;
- Leave a vehicle unlawfully;
- Perform an unrelated personal task;
- Enter private property beyond what is reasonably necessary;
- Engage in abusive or dangerous conduct.
18. Failed delivery
A delivery may be treated as unsuccessful when:
- The address is incorrect;
- The Customer cannot be contacted;
- Access is impossible;
- The location is unsafe;
- The Customer refuses the correct Order;
- Required age or identity verification cannot be completed;
- Delivery would violate law.
The Driver or support team may attempt to contact the Customer and wait for a reasonable period.
Where failure is caused by the Customer, the Customer may remain responsible for the Order and delivery charges to the extent permitted by law.
19. Proof of delivery
Delivery completion may be confirmed through:
- Customer confirmation;
- One-time code;
- Signature;
- Photograph;
- Geolocation;
- Timestamp;
- Driver confirmation;
- Other reasonable evidence.
Proof-of-delivery photographs must focus on the Order and delivery location and should avoid capturing individuals, private interiors or unrelated personal information where possible.
20. Restricted and regulated products
The App may restrict or prohibit products based on local law and TableGreet policy.
Where age-restricted products are legally offered, the Customer may be required to:
- Meet the legal minimum age;
- Present valid identification;
- Complete age verification;
- Receive the Order personally;
- Avoid requesting unattended delivery.
A Driver or Venue must refuse delivery when legally required verification fails.
TableGreet may impose stricter restrictions than local law.
21. Rewards, credits and promotions
Rewards, vouchers, referral credits and promotional codes may be governed by additional terms.
Unless otherwise stated:
- They have no cash value;
- They cannot be sold or transferred;
- They are limited to one eligible user or account;
- They may expire;
- They may apply only to specified Venues, cities or Order types;
- They may not cover taxes, tips or certain fees;
- They may be revoked if obtained through fraud, abuse or mistake.
Refunds may reduce, reverse or cancel rewards earned from the refunded transaction.
TableGreet may modify or discontinue a promotion, but will not unlawfully remove benefits already earned.
22. Customer responsibilities
Customers agree to:
- Treat Venue staff and Drivers respectfully;
- Provide accurate account and delivery information;
- Use authorized payment methods;
- Review Orders before submission;
- Follow safety instructions;
- Report issues honestly;
- Comply with applicable law.
Customers must not:
- Place fake Orders;
- Commit payment fraud;
- Abuse refund processes;
- Manipulate QR codes;
- Harass or threaten others;
- Submit false safety complaints;
- Interfere with deliveries;
- Use bots or unauthorized automation;
- Scrape App content;
- Attempt unauthorized access;
- Abuse promotions;
- Resell App access;
- Use the App for illegal purposes.
23. Driver onboarding and verification
Drivers may be required to complete:
- Identity verification;
- Age verification;
- Driver’s-license verification;
- Right-to-work verification;
- Vehicle verification;
- Insurance verification;
- Background or safety screening where lawful;
- Tax and payout registration;
- Training or onboarding.
Providing false, altered or expired documents may result in rejection or suspension.
Approval in one city or country does not guarantee eligibility elsewhere.
24. Driver account use
A Driver account is personal to the approved Driver.
Drivers must not:
- Share or rent their account;
- Permit another person to complete deliveries;
- Use false location information;
- Manipulate delivery availability;
- Falsify pickup or completion;
- Use unauthorized software;
- Create duplicate accounts;
- Evade safety or identity controls.
TableGreet may require periodic identity checks.
25. Driver availability and delivery opportunities
Drivers may choose when to go online unless a separate written agreement or local law states otherwise.
Going online does not guarantee:
- A minimum number of offers;
- A minimum level of earnings;
- Exclusive access to a territory;
- Continuous availability of work.
Drivers may generally accept or decline delivery opportunities, subject to:
- Any disclosed service-quality rules;
- Restrictions on abandoning an accepted delivery;
- Local laws;
- Safety requirements;
- Fraud-prevention measures.
Offer presentation may consider:
- Driver location;
- Vehicle type;
- Order requirements;
- Estimated pickup time;
- Current delivery status;
- Safety;
- Driver eligibility;
- Operational efficiency.
26. Driver service standards
Drivers must:
- Complete accepted deliveries carefully and promptly;
- Follow lawful pickup and delivery instructions;
- Handle Orders hygienically;
- Protect Orders from damage or interference;
- Use appropriate delivery equipment;
- Confirm pickup and delivery accurately;
- Communicate respectfully;
- Follow traffic and parking laws;
- Avoid discrimination and harassment;
- Protect Customer information;
- Report safety incidents;
- Avoid opening, consuming or modifying sealed Orders.
Drivers must not complete deliveries while impaired, dangerously fatigued or otherwise unable to drive safely.
Safety takes priority over delivery speed.
27. Driver vehicles, equipment and expenses
Unless otherwise stated in a local agreement, Drivers are responsible for:
- Vehicle acquisition or rental;
- Fuel or charging;
- Maintenance;
- Registration;
- Insurance;
- Protective equipment;
- Telephone and mobile data;
- Taxes;
- Other operating expenses.
Vehicles must be:
- Legally permitted;
- Roadworthy;
- Suitable for the delivery;
- Accurately registered in the Driver account.
TableGreet may establish minimum equipment or food-handling requirements.
28. Driver insurance and licenses
Drivers must maintain all licenses, registrations, permits and insurance required for the delivery activity and vehicle.
Drivers must notify TableGreet promptly if:
- A license expires, is suspended or revoked;
- Insurance lapses;
- The vehicle becomes unsafe;
- Legal eligibility changes;
- An incident affects the ability to provide services.
TableGreet may request updated documents at any time.
29. Driver earnings and payouts
The Driver App may display:
- Base delivery payment;
- Distance or time components;
- Incentives;
- Bonuses;
- Tips;
- Deductions;
- Adjustments;
- Estimated total earnings.
The applicable calculation will be shown before or after the delivery as required by local law.
Payouts may be subject to:
- Identity verification;
- Bank processing times;
- Minimum payout thresholds;
- Fraud review;
- Chargeback adjustments;
- Legally required withholding;
- Correction of calculation errors.
Drivers must provide accurate payout and tax information.
Questions concerning earnings should be reported within 30 days.
30. Driver tips
Tips designated for Drivers belong to the Driver, subject to:
- Required tax withholding;
- Payment reversals;
- Fraud;
- Processing treatment disclosed in the App;
- Applicable law.
TableGreet will not intentionally reduce base earnings because a Customer provides a tip unless this is clearly disclosed and legally permitted.
31. Driver taxes
Drivers are responsible for understanding and satisfying applicable tax obligations unless local law requires TableGreet or another party to withhold, collect or report taxes.
TableGreet may:
- Request tax information;
- Issue required tax documents;
- Withhold amounts required by law;
- Report earnings to authorities;
- Share required information with payment providers.
TableGreet does not provide personal tax advice.
32. Driver relationship
Unless a separate written agreement or applicable law states otherwise, the Driver provides delivery services as an independent service provider and not as an employee, partner, agent or representative of TableGreet.
Nothing in these Terms determines employment status where status is established by mandatory local law or the actual working relationship.
Drivers have no authority to:
- Bind TableGreet;
- Make promises on TableGreet’s behalf;
- Modify Customer or Venue agreements;
- Represent themselves as TableGreet employees unless formally employed.
Local Driver terms may replace or supplement this section.
33. Driver safety and emergencies
Drivers should:
- Follow all traffic laws;
- Use lawful navigation practices;
- Stop safely before interacting with the App;
- Avoid handling the device while driving;
- Decline or discontinue an unsafe delivery;
- Contact emergency services when immediate assistance is required;
- Report serious safety incidents through the App.
TableGreet may contact a Driver, Customer, emergency contact or relevant authority when reasonably necessary to address an urgent safety concern.
34. Driver reviews, complaints and deactivation
Driver performance may be assessed using:
- Delivery completion;
- Accuracy;
- Customer feedback;
- Venue feedback;
- Safety reports;
- Fraud signals;
- Delivery delays;
- Account verification;
- Compliance with these Terms.
TableGreet may temporarily restrict or suspend a Driver account during an investigation.
Except where immediate action is reasonably necessary for safety, fraud or law, TableGreet will attempt to provide:
- Notice of the reason;
- An opportunity to provide information;
- Access to an appeal process;
- Review by an appropriate person.
Ratings will not be the sole basis for a legally significant decision where prohibited by law.
35. User content
Users may be able to submit:
- Reviews;
- Ratings;
- Photographs;
- Comments;
- Support evidence;
- Delivery instructions;
- Profile information.
Users retain ownership of their original content.
Users grant TableGreet a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display and use that content only as reasonably necessary to:
- Operate the Services;
- Display submitted content;
- Promote a publicly submitted review or contribution;
- Moderate content;
- Investigate complaints;
- Protect users;
- Improve the Services.
This license ends when the content is deleted, except for copies reasonably retained in backups, legal records or content already shared by the user publicly.
Users must not submit content that:
- Is unlawful;
- Is threatening or abusive;
- Violates privacy;
- Infringes intellectual property;
- Contains malicious code;
- Is knowingly false;
- Includes unnecessary sensitive personal information;
- Promotes fraud;
- Constitutes spam.
We may remove or restrict content that violates these Terms.
36. Intellectual property
The App, software, interfaces, branding, designs, databases, text and other TableGreet materials are owned by or licensed to TableGreet.
Subject to these Terms, TableGreet grants the user a limited, personal, revocable, non-exclusive, non-transferable license to install and use the App for its intended purpose.
Users must not:
- Copy or redistribute the App;
- Sell or sublicense access;
- Reverse engineer the App except where law expressly permits;
- Circumvent technical protections;
- Remove legal notices;
- Use TableGreet trademarks without permission;
- Create a competing database through scraping;
- Use App content to train automated systems without written authorization.
37. Feedback
Users may voluntarily provide suggestions or feedback.
TableGreet may use non-confidential feedback without payment or restriction, but this does not transfer ownership of confidential information or pre-existing intellectual property.
Do not submit confidential business information through general feedback channels.
38. Third-party services
The App may integrate with third-party services such as:
- Payment processors;
- Maps;
- Navigation;
- Authentication;
- Messaging;
- Venue websites;
- Device operating systems.
Third-party services may have separate terms.
TableGreet is not responsible for an independent third party’s service, except where responsibility cannot legally be excluded.
39. Electronic communications
By using the App, users agree to receive electronic communications concerning:
- Account activity;
- Orders;
- Payments;
- Deliveries;
- Security;
- Driver operations;
- Policy updates;
- Support.
Electronic records and communications may satisfy legal writing requirements where permitted.
Marketing communications can be disabled through the available unsubscribe or settings controls.
40. App updates
TableGreet may release updates to:
- Improve security;
- Fix errors;
- Add features;
- Maintain compatibility;
- Meet legal requirements.
Some updates may be required to continue using the App.
TableGreet may modify or discontinue a feature, but will take reasonable steps to avoid unfairly interfering with active Orders, Driver earnings or legally protected rights.
41. Suspension and termination
TableGreet may restrict, suspend or terminate access when reasonably necessary because of:
- Material violation of these Terms;
- Fraud;
- Payment abuse;
- Safety risk;
- Harassment;
- Illegal activity;
- False identity;
- Account sharing;
- Repeated service abuse;
- Legal or regulatory requirements;
- Security threats.
Where appropriate, we will provide notice and an opportunity to appeal.
Users may stop using the App and request account deletion at any time.
Sections that logically continue after termination remain effective, including payment obligations, intellectual-property rules, dispute provisions and liability terms.
42. Service availability
The App may not be available in every country, city or Venue.
Features may vary based on:
- Location;
- Venue participation;
- Local law;
- Device;
- App version;
- Payment-provider availability;
- Driver availability.
We do not guarantee uninterrupted or error-free operation.
We may temporarily restrict the App for maintenance, security or operational reasons.
43. Disclaimers
To the maximum extent permitted by law:
- The App is provided on an “as available” basis;
- Estimated times are not guaranteed unless expressly stated;
- TableGreet does not guarantee that every Venue or Driver will be continuously available;
- TableGreet does not independently verify every menu statement;
- Venue food and products are supplied by the Venue;
- Third-party services remain subject to their own operation and terms.
These disclaimers do not exclude warranties or rights that cannot legally be excluded, including mandatory consumer rights.
44. Limitation of liability
Nothing in these Terms excludes or limits liability for:
- Fraud;
- Fraudulent misrepresentation;
- Death or personal injury caused by negligence where liability cannot be excluded;
- Willful misconduct;
- Gross negligence where applicable;
- Breach of mandatory consumer rights;
- Any other liability that cannot legally be excluded.
Subject to those exceptions and to the maximum extent permitted by law, TableGreet will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when the user accepted these Terms.
For users acting for business purposes, TableGreet’s aggregate liability arising from the Services during a 12-month period will not exceed the greater of:
- The amount paid directly to TableGreet by that user during that period; or
- $100 USD.
Any limitation applicable to consumers will operate only to the extent permitted by mandatory local law.
45. User responsibility and indemnity
Business users and Drivers agree, to the extent permitted by law, to compensate TableGreet for third-party claims, damages and reasonable costs resulting from their:
- Material violation of these Terms;
- Unlawful conduct;
- Infringement of another person’s rights;
- Fraud;
- Unauthorized use of an account;
- Failure to maintain required licenses or insurance.
This section does not require consumers to compensate TableGreet for ordinary use of the App or matters caused by TableGreet.
46. Informal dispute resolution
Before filing a non-urgent legal claim, the user and TableGreet should attempt in good faith to resolve the issue informally.
A written dispute notice should include:
- Account contact information;
- Description of the issue;
- Relevant Order or delivery information;
- Requested resolution.
Notices to TableGreet must be sent to legal@tablegreet.com.
The parties will have 30 days after receipt to attempt resolution.
This process does not prevent either party from:
- Seeking urgent protective relief;
- Reporting a matter to a regulator;
- Exercising non-waivable consumer rights;
- Filing a claim before a limitation period expires.
47. Governing law and courts
These Terms are governed by the laws of the State of California, USA and the Kingdom of Morocco, excluding conflict-of-law rules.
Subject to mandatory consumer-protection law, the courts of San Francisco, California and Rabat, Morocco will have jurisdiction over disputes.
Consumers may also have the right to bring claims in the courts of their country or place of residence.
Nothing in this section removes rights granted by mandatory local law.
48. International use
Users are responsible for complying with laws applicable to their use of the App.
TableGreet may restrict access in a country or region where:
- The Services are not legally available;
- Payments cannot be supported;
- Trade restrictions apply;
- Regulatory approval is required;
- Safety or operational requirements cannot be satisfied.
49. Apple App Store terms
Where the App is downloaded through Apple’s App Store:
- These Terms are between the user and TableGreet, not Apple.
- TableGreet, not Apple, is responsible for the App and its content.
- The license is limited to use on Apple-branded products owned or controlled by the user and as permitted by applicable App Store usage rules.
- Apple has no obligation to provide maintenance or support for the App.
- Where the App fails to comply with an applicable warranty, the user may notify Apple and Apple may refund the purchase price paid for the App, if any, as required by Apple’s rules.
- To the maximum extent permitted by law, Apple has no other warranty obligation concerning the App.
- TableGreet, not Apple, is responsible for addressing claims relating to the App, including product-liability, legal-compliance and consumer-protection claims.
- TableGreet, not Apple, is responsible for investigating and resolving claims that the App infringes third-party intellectual property.
- The user confirms that they are not located in a country subject to applicable government embargoes and are not listed on applicable prohibited-party lists.
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.
50. Google Play terms
Where the App is obtained through Google Play:
- These Terms are between the user and TableGreet, not Google.
- Google is not responsible for the App or its content.
- Use of Google Play remains subject to applicable Google Play terms.
- Google has no obligation to provide support for the App.
- TableGreet is responsible for claims relating to the App to the extent required by law.
51. Changes to these Terms
We may update these Terms because of:
- Product changes;
- New features;
- Legal requirements;
- Security needs;
- New countries or business models.
The updated Terms will display a revised effective date.
For material changes, we will provide reasonable notice through the App, email or another appropriate method.
Where required, continued use will require renewed acceptance.
Changes will not retroactively alter completed transactions unless required by law or agreed by the affected parties.
52. General provisions
Entire agreement
These Terms, the Privacy Policy and any applicable supplemental terms form the agreement concerning the App.
Supplemental terms
Driver, promotional, payment, rewards, country or Venue-specific terms may apply. If supplemental terms conflict with these general Terms, the supplemental terms control for the relevant subject.
Severability
If a provision is held unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue.
No waiver
Failure to enforce a provision does not waive the right to enforce it later.
Assignment
Users may not transfer these Terms without TableGreet’s written permission. TableGreet may transfer these Terms as part of a merger, reorganization or business transfer, subject to applicable law and continued protection of user rights.
Language
Translations may be provided for convenience. English shall be the controlling language, except where local law requires another language to control.
Headings
Headings are provided for convenience and do not affect interpretation.
